Here is what happened.

Four sellers were on title. All four signed the purchase agreement. Escrow saw four signatures and assumed it was a normal transaction.

Midway through, escrow discovered one of the sellers had passed away. The first question out of everyone’s mouth was “who signed for the dead guy?” 👀

Now they needed a death certificate. A copy of the trust. And answers nobody had ready. 📋

The wife had been signing on her husband’s behalf the whole time. She did not know she was not supposed to.

If you are the listing agent, you need to know whether all your sellers are alive before you ever open escrow. Get ahead of it. Not in the middle of it. ⚠️

My rule now: if I have multiple sellers, I am meeting with all of them. In person. On Zoom. On the phone. I need to see or hear every single one before any paperwork gets signed. 📞

Honestly it’s a 50/50 for me. I feel like it would depend on the rules surrounding it. If there are rules making it so it’s is fair for all buyers, sellers and agents then I would say no it don’t think it is.
