A buyer called me yesterday wanting free comps and a lien search on an off-market FSBO deal.

No representation agreement. No transaction. Just… free consulting. 🤔

Here’s the problem:

Per NAR, we are required to have a representation agreement in place. And per California state law, you must have one as soon as practicable. 📋

If you’re pulling lien searches and giving valuations, that’s practicable. That agreement should already be signed. ✋

And even if I wanted to give it away for free…

No rep agreement = no E&O coverage. 🚫

If I miss a lien and that deal goes sideways, I’m exposed. Personally. With zero protection.

So I had to say no. And I’d say no again. 💯
